Commitment to the Human Rights Policy
RATCH Group Public Company Limited is aware that respect for human rights is an essential for business operations. The Human Rights Policy is promulgated to demonstrate our commitment to uphold, support and promote the respect and protection of the basic rights and dignity of all individuals involved, in consistent with domestic legislation, international human rights principles and business best practices, namely:
- Universal Declaration of Human Rights (UDHR).
- United Nations Guiding Principles on Business and Human Rights (UNGPs).
- Principles of the United Nations Global Compact (UNGC).
- Declaration on Fundamental Principles and Rights at Work and Core Conventions of the International Labour Organization (ILO)
- OECD Guidelines for Multinational Enterprises on Responsible Business Conduct.
- Children's Rights and Business Principles (CRBP).
The Company is committed to respecting and upholding international principles that support human rights and fair labor practices, in alignment with internationally recognized standards for responsible business conduct.
Scope of Policy
The Company shall apply the Human Rights Policy as a framework for human rights management, guiding the Company and its controlled entities in Thailand and overseas in conducting business and all activities involving employees, labor, supply chain, community, and society.
Furthermore, the Company shall encourage its joint ventures, business partners, suppliers and relevant parties in the supply chain of the Company and its controlled entities in Thailand and overseas to conduct their business with respect for human rights by applying or adapting to the Human Rights Policy.
Definitions
Human Rights are the rights inherent to all human beings, regardless of race, color, gender, language, religion, education, tradition, culture, social status, property, residential or territory status, political opinion, or any other legal status or binding commitment. All individuals, without any discrimination, are entitled to equality, freedom, and protection from slavery and torture. Everyone has the right to freedom of opinion and expression, as well as the right to work and to fair and equal remuneration that ensures a satisfactory standard of living.
Provision in the Human Rights Policy
The Company’s Board of Directors, executives and employees ensure respect for human dignity, equitable and fair treatment of all stakeholders, and equal opportunity for all without discrimination regardless of race, nationality, color, gender, gender identity, age, religion, language, belief, social status, family background, disability, political opinion, as well as relevant legal and human rights principles. Furthermore, the Company places great importance on protecting and promoting the rights of vulnerable and disadvantaged groups who may be at risk of rights violations and discrimination. Accordingly, the Company shall conduct its business with care and diligence to ensure that to prevent human rights violations in the course of its operations as guided by the provisions of the Human Rights Policy as follows:
- The Company commits to a zero tolerance of child labor by clearly specifying minimum age criteria and conditions of employment fully comply with local labor laws in each country. This demonstrates the Company’s commitment to respecting and promoting children's rights by avoiding business practices that may negatively impact them and by supporting child development through responsible business operations.
- The Company shall promote fair employment by ensuring fair, equal, and transparent treatment of all employees and workers, including migrant workers, across all operations. Employment agreements shall specify clear and mutually agreed terms and conditions, covering wages and welfare benefits, working hours, overtime, work on holidays, paid sick leave, and other leaves and holidays without any deductions, as well as other fringe benefits not less than those required by law. The Company also ensures maternity protection for pregnant employees and workers, including right to maternity leave covering the postnatal period, maternity pay and/ or compensation not less than the legal requirements, and the right to return to the same job after maternity leave.
- The Company is committed to providing fair wages and compensation without discrimination based on gender or age. It complies with minimum wage laws and ensures that all legally mandated benefits are provided. Furthermore, the Company supports the provision of an appropriate living wage by considering the economic context and cost of living in each country where it operates.
- The Company shall set working hours in accordance with labor laws, including maximum working hours and overtime limits as prescribed by law, to prevent excessive overtime and promote a healthy balance between work and employees’ quality of life.
- The Company applies a zero-tolerance policy toward all forms of forced labor, strictly adhering to the employment terms and conditions as prescribed by local labor laws in each country. Assignments to employees and workers are made based on their consent and individual capabilities. The Company does not tolerate human trafficking or any exploitation of labor that violates human rights principles, including prison labor, slave labor, or any other forms of forced labor exploited for benefits of its own operations, supply chain, and controlled entities.
- The Company respects the rights and freedoms of employees and workers to voluntarily participate or not participate in activities. They also enjoy freedom of expression as long as it does not violate any laws or moral principles.
- The Company respects and supports the freedom of association and the right to collective bargaining for employees and workers. It also provides opportunities for them to communicate and express their views to management on matters related to welfare and working conditions, without any threats, intimidation, or discrimination.
- The Company promotes the safety and occupational health of individuals and assets of the Company, including employees, workers, relevant stakeholders, entities under its control, and those within its supply chain. It ensures a safe working environment through preventive safety measures and risk monitoring systems in line with applicable safety and occupational health legislation. The Company also provides safety training to its suppliers and contractors prior to commencement of work, in alignment with international occupational health and safety standards and the Company’s internal safety regulations.
- The Company opposes and refrains from all forms of discrimination, intimidation, harassment, and violence. This includes actions that humiliate individuals based on their differences, physical and verbal sexual harassment, and inappropriate workplace behavior that may imply sexual harassment or cause physical or emotional distress, thereby violating human dignity and compromising workplace safety.
- The Company respects the rights of Indigenous and ethnic peoples in all areas of operation. It acknowledges, protects, and preserves their traditions, wisdom, heritage, culture, and original rights of Indigenous peoples, as well as their cultural legacy.
- The Company supports the improvement of quality of life for local people in communities and society equally, without discrimination. It promotes access to educational opportunities, internships, vocational training, and suitable employment placements to enhance experience and foster sustainable entry into the labor market.
- The Company has established human rights due diligence procedures and systems within the organization and in controlled entities and supply chain. This applies to both existing operations and new acquisitions, including mergers and joint ventures. The process includes identifying salient human rights issues, analyzing potential impacts, and implementing preventive and mitigation measures. Procedures for remediation and rehabilitation will also be designed in an appropriate, legitimate, and generally accepted manner. The Company places strong emphasis on stakeholder engagement throughout the due diligence process. Moreover, the Company will implement regular monitoring of human rights violations, the compliance with the Human Rights Policy, and consistent reporting and disclosure on human rights to build trust and accountability at all levels of its business operations.
- The Company accepts complaints and reports of human rights violations related to the activities of the Company, its controlled entities, and supply chain through website: www.ratch.co.th. The Company assures fairness and protection for complainants or individuals who report the Company’s related human rights violations in accordance with complainant protection measures as specified in the Company’s Code of Conduct. All information received will be kept confidential, and the identity of the complainant or any personally identifiable information will be kept anonymous and will not be disclosed.
- In cases where the Company causes or is involved in human rights violations, it will provide appropriate, timely, and effective remediation and assistance to affected individuals. It will also take disciplinary action against offenders and implement preventive measures to avoid recurrence.
- The Company is committed to fostering and embedding a corporate culture that incorporates respect for human rights by actively monitoring and not neglecting or ignoring any acts that may violate human rights in any case. The Company will consistently communicate, publish, educate, and provide human rights training to the Board of Directors, executives, employees of the Company, its controlled entities, and supply chain on a continuous and regular basis to raise awareness and understanding of the Company’s Human Rights Policy and to strengthen the capacity to prevent and appropriately respond to related incidents.
- The Company will conduct an annual review of the Human Rights Policy, or whenever critical events have occurred, to ensure that the policy remains up-to-date and aligned with applicable laws, international principles, and/or business circumstances.
- Violations of human rights are considered breaches of the Company’s Code of Conduct, and violators are subject to disciplinary action or criminal prosecution if their misconduct constitutes a violation of the laws.
In enforcing the policy, should any clause contradict the legislation, rules and regulations in applicable areas, it shall be superseded by the legislation, rules and regulations.
